landlords responsibilities regarding problem neighbours

don't know if anyone knows anything about this or can offer any advice?

basically our neighbours (we're in a council place, next door neighbours bought theres, have moved out and now rent it out to some new people) are up reguarly (3 - 4 nights a week) till 3-4 am screaming at shouting at each other (well him at her mainly)

i know it doesnt sound like a big deal but after months of this now its doing my head in, i work shifts, so am often up at 4am and trying to sleep with this cunt screaming the place down is a nightmare!

started last night at about 11 and went on, off an on till at least half 2! i banged on the wall at about 1am and the cunt just banged back. my mum got up and knocked on the door, all he did was carry on screaming and shouting. heard him open the door so i decided to go out, as i got there he was shouting at my mum for banging on the door, so i kind of lost it and shouted an swore at him for a bit, he just looked at me after told me to calm down, so i told him to fuck off telling me to calm down etc etc!

all i could get out of him was 'safe' 'safe' 'safe'

anyway, went bk in, 15 mins later the cunt starts at it again!

have rang his landlord today, and he said they told him they were just talking and theres nothing he can do about it.

sorry for war and peace, but does anyone know anything about this kind of stuff? does their landlord have anysort of responsibility to his neighbours?

apparantly another neighbour went round there and she said something to them about having had enough of it and is going to kill herself (she's also pregnant) they did call the police on that occasion.

thing is when you go round there i think he sends her to the door, as she usually answers it and probably takes the brunt of the complaints which he just ignores

we've been to the council, not there problem, though they have passed it over to environmental health

might try recording the noise next time

went through a stage when i was on earlies, if they kept me up, id go an bang on the door at 4.30 am when i was leaving, hammered it till they answered then told them i'd wake them up every morning they kept me awake.

Getting back to the original question. I am by no means a legal advisor, but I've had some experience with this, and here's what I think:

I don't think that it's the landlord's responsibility to deal with the disruption that his tenants cause in or around a rented property.

I do believe that it's the landlord's reponsibility to make sure the he is putting the right people into his property. If you talk to him, then most reasonable people would try to do something about it. They might have a word with their tenants, and this would prevent any neighbour being singled out for retribution.

It had been suggested earlier in the thread to keep records of the noise for a week or two. I think that's a good idea. It seems like you're at the end of your tether with these folks, so it's probably easier said than done for you right now.

If you keep going around and complaining, I have heard that this could be regarded as harassment on your part.

Once you have the records of what's been going on, and the landlord hasn't been able to have an effect, then go to the police. At least if you have something to show them, they might file a report at least. If you don't have the records, I think they'd probably suggest you do that, and then come back.

In these situations, resorting to violence won't help anything - don't forget, if/when they move out (you probably won't know where they have moved to), they will know where you live......there are all sorts of people out there, and you never know what someone could do for "revenge".

Smacking the guy in the mouth might make you feel better, but you're better off detatching yourself from the situation (again, easier said than done) and playing by the "rules".

these kids are neither more likely or least likely to do those things than any other kids

I apologised for using the term even before I used it, but the thread had moved onto generalizing race, and I was just pointing out that it should make no difference who they are, just make them think you are mental and they'll leave you be

It's about having a decent standard of living. I don't want to listen to a load of attention seeking blerts kick up any type of fuss they can, all fucking night. I dont want my kids to have to listen to kick offs all night, loads of swearing, fights, police & ambulances at all hours of the day. It not on.

I don't want my kids having to walk pass unconscious pissheads lying in the middle of the road outside our house..
got a knock from a neighbor asking if I thought we should call an ambulance for the knobhead lying in the road. I went and filled a 5 gall bucket with water and poured it over the knobheads head.
. He wasn't happy but we didn't need an ambulance. He fucked off, haven't seen him for a while.

When I moved on to our estate it was horrible. Full of vermin. Somewhere the Welsh authorities put all the English pissheads and druggies who had moved into the area. It was known by the locals as Tan y Bronx or city of sin
Now it's quiet and crime free.
A very nice place to live, were everyone can get on with all their illegal activates with out have the police on here every day.
Standard of living is a must..

back to the topic of noisy neighbours, my parents have had the neighbours from hell living next door for about 3 years now, (for the record, a white scouse couple living in london)

shes an alcoholic and screams and shouts all night every night, he's a quiet fella and just takes the abuse, every other night she comes round banging on my parents door asking for help at 3,4,5 am police cars turn up every other week too and do nothing, she's the one that calls them in her drunken rage saying he beats her up, but he's the one usually covered in bruises. to top it all off they have a huge dog that barks constantly, dont think it ever gets taken for walks, just left in the garden.

when they make noise at night my old fella just puts on the kerrang channel using the lovely loud surround sound system i bought them for exactly this purpose, speakers facing the wall, crank it up to the max put in some earplugs and wait for their noise to stop, which it usually does after about ten minutes.

if it goes on much longer my old man wants to swap houses with me for a while so i can give them a taste of their own medicine, i'll happily give it a go.

never had that problem myself thank god. you know a good neighbour is better than a good relative so it's desperate with some fool lives next door to you.

record everything. take notes even record it through some sort of audio device. proof is everything.

I had problems like this and got the environmental people involved in it in Dundee. Basically they said that you have to keep a note of all the times that you hear them, going to them with nothing isn't going to help. They will then probably ask you to keep a note of when its happening and give you a tape recorder to record the sound, this way they can see if its loud. IF you do contact the police about it get the call reference number so that you can pass it to the environmental people this would back up your case to show that they are being loud.

DONT go around threatening the git no matter how you feel. You would be in the wrong and if you have the council on your case they don't look to good at it if you try and retaliate. Do it properly and you could get peace and quiet in a month! I know not much help when you are needing the sleep but it should help in the wrong run.
